ABA joined with the American Beverage Association, PepsiCo, Food Marketing Institute and the Snack Food Association this week in sharing concerns about the new Hours of Service (HOS) rules with officials at the Federal Motor Carrier Safety Administration (FMCSA).
In a meeting on August 19, the industry group focused on the 34 hour restart and the two mandatory periods between 1 and 5 am. FMCSA officials were interested in how much drivers actually need to use the restart, noting that drivers on duty for 10 hours, six days a week, with Sunday off, would not need to invoke this option.
In terms of any kind of industry exemption from any of the HOS requirements, FMCSA stated that a formal petition would need to be filed, including proposing regulatory alternatives to achieve the “equivalent level of safety” provided by existing rules.
ABA, and its industry allies, will continue to work to maintain an open dialogue with FMCSA, as well as educating members of Congress about the impact of the HOS rules on bakers and bakery fleets.
