ABA worked with members of the U.S. Senate to weigh in and encourage FDA to not finalize their determination until they have reviewed the pending food additive petition that is expected to be filed with FDA later this week, as well as the Agency defining partially hydrogenated oil and allowance for a reasonable reformulation transition time.

Also with regard to the pending Kummerow v. FDA litigation, on Friday, May 22 FDA stated that its final decision on GRAS status of PHOs is expected on June 15. FDA asked for a further stay of the case until June 22, and the parties will report at that time on whether any further proceedings are warranted. Nothing more was revealed in the update to the court. ABA will update the membership as more information becomes available.
