Regulatory Movement Post Shutdown
The Department of Labor has sent a proposed regulation to define what constitutes “regular rate” of pay for purposes of calculating overtime compensation to the Office of Information and Regulatory Affairs (OIRA).
·Many employers have begun providing various benefits to help in recruiting the best employees, such as gym memberships, employee discounts on merchandise, and even student loan repayment assistance.
·Some employers have faced litigation claiming that these benefits should be included in the regular rate of pay when calculating overtime, tremendously increasing how much must be paid in overtime.
We do not yet know the content of this proposed regulation but clarifying what must be included in regular rate and allowing employers to continue to offer benefits without them being included in regular rate, is a high priority.
Another Regulation, the long-awaited proposed overtime regulation is also at OIRA for review.
We also do not know what this proposal includes but the fact it is now at OIRA suggests DOL may be able to make the March 2019 window for publishing the proposal.
